Mediante este Comunicado la DIAN recuerda a los agentes de retención y/o autorretenedores de CREE la posibilidad, consagrada en la reciente Reforma Tributaria (Ley 1819 de 2016), de sanear las declaraciones ineficaces. Así mismo, advierte, que “los responsables del Impuesto sobre las Ventas del Régimen Común que, al 30 de noviembre de 2016, hayan presentado declaraciones por este impuesto en un período gravable diferente al obligado, pueden corregir dicha inconsistencia presentando las declaraciones correspondientes por el período gravable respectivo, sin liquidar y pagar la sanción por extemporaneidad ni los intereses de mora”. En ambos casos se indica el procedimiento a seguir.

El inciso primero del artículo 462-1 del Estatuto Tributario, modificado por el artículo 46 de la Ley 1607 de 2012, incorporó como tarifa aplicable a la base gravable especial AIU, la tarifa general vigente en el momento que correspondía a la tarifa del 16%, sin embargo el artículo 184 de la Ley 1819 de 2016, norma posterior, modificó el artículo 468 del Estatuto Tributario estableciendo una nueva tarifa general del IVA al 19% sin incluir excepción alguna para el caso de la aplicación a la base gravable especial del AIU.
